1. ABOUT NOIRELITH
This website is operated by NOIRELITH LLC, trading as NOIRELITH. In these Terms, “we,” “us,” and “our” refer to NOIRELITH LLC.
We offer sensual lingerie and accessories through noirelith.com. Our store is hosted on Shopify, which provides the ecommerce platform we use to sell our products.
These Terms govern your use of our website and purchases from us, together with the order information and policies made available before you purchase:

Our Privacy Policy explains how personal information is handled. It does not replace any consent required by applicable law.
Nothing in these Terms excludes or limits consumer rights that cannot lawfully be excluded or limited.
2. ELIGIBILITY AND ACCOUNT INFORMATION
Our store is intended for adults. To place an order, you must be at least 18 years old and have the legal capacity to enter into a purchase agreement under the laws applicable to you.
You must provide accurate and complete contact, payment and delivery information. You must be authorised to use the payment method submitted with your order.
If you create an account, keep your login details secure and contact us promptly if you suspect unauthorised use.
3. PRODUCT INFORMATION, FIT AND IMAGES
Our collection may include sheer and lace lingerie, strappy and open designs, fishnet garments, bodystockings, garters and accessories.
Please review the description, selected variant, available measurements, material information and included-item list before ordering.
“One Size” describes a sizing option; it does not mean that a product fits every person. Fit depends on the design, measurements, stretch and adjustability of the individual item. If fit information is missing or unclear, contact us before purchasing.
Transparency, coverage and openings vary by style. Accessories shown in styled photographs are included only where the product description or selected variant expressly states that they are included.
We aim to represent products accurately. Screen settings and lighting can affect how colours appear. These differences do not excuse supplying a defective item or an item materially different from its description.
Editorial or AI-generated concept imagery, where identified as such, illustrates the brand’s visual direction and does not replace the description or photographs of the product being purchased.
Product information may be updated for future purchases. We will not materially change the specifications of an accepted order without your agreement.
4. ORDERS AND AVAILABILITY
Submitting an order is an offer to purchase the selected items. An automated order-received email acknowledges receipt and does not by itself confirm acceptance.
We accept your order when we send a dispatch confirmation or an earlier communication expressly confirming acceptance. Any earlier payment collection does not limit your cancellation or refund rights under applicable law.
Before acceptance, we may decline an order for a legitimate reason, including unavailable stock, a material pricing error, suspected fraud or a legal restriction. We will notify you and promptly refund any payment taken for items we cannot supply.
We will not substitute a different product, colour or size without your agreement.
If you notice an error in your order or wish to request cancellation, contact hello@noirelith.com promptly. We will try to accommodate changes before dispatch. This does not restrict any statutory cancellation or withdrawal rights.
5. PRICES, PAYMENT AND TAXES
The applicable price and currency are shown when you place your order. Shipping charges and taxes that we collect will be shown before you complete checkout, as required by applicable law.
For international deliveries, any customs duties, import taxes or clearance charges not collected at checkout will be allocated according to the delivery terms disclosed before purchase and applicable law. We will not require you to pay a charge that the law requires us to bear.
If a material pricing or billing error affects your order, we will contact you to explain the issue and, where appropriate, offer a corrected order or cancellation with a refund. We will not charge an increased amount without your agreement.
Price changes do not retrospectively alter an accepted order.
6. SHIPPING AND DELIVERY
Orders are fulfilled through our partners in China. NOIRELITH remains your point of contact for order support, delivery issues and applicable remedies.
Available destinations, shipping charges and relevant processing and delivery information are provided in our Shipping Policy, product information or checkout.
Delivery estimates are not guaranteed dates unless expressly stated. However, estimates do not remove our legal obligations concerning shipment, delivery, delay notices or refunds.
If we cannot ship within the stated period, we will notify you and provide any revised estimate, cancellation option or refund required by applicable law. Where consent to a delay is required, we will obtain that consent.
Please provide a complete and accurate delivery address. Contact us promptly about an address error. Any additional delivery charges will be explained and applied only where permitted by law.
If your parcel is lost, damaged or marked delivered but cannot be located, contact us so we can investigate and provide the remedy required by the circumstances and applicable law. We do not automatically transfer all responsibility to you when a parcel is handed to a carrier.
Any mandatory rules governing delivery and the transfer of risk take priority over these Terms.
7. RETURNS, CANCELLATIONS AND FAULTY ITEMS
Please review our Refund Policy before purchasing. It explains our return procedure and any voluntary return conditions.
Lingerie is not automatically excluded from all return or refund rights. Where applicable law permits an exception for sealed goods unsuitable for return for health protection or hygiene reasons after unsealing, that exception will apply only when its legal conditions are met.
Any valid hygiene restriction on change-of-mind returns does not remove your rights concerning defective, damaged, incorrect or materially misdescribed goods.
Where a statutory withdrawal or cancellation right applies, we will honour it. A request to contact us for return instructions does not make a statutory right subject to discretionary approval.
Contact hello@noirelith.com for assistance. Please obtain the appropriate return instructions before sending goods; the dispatch address or our business address may not be the designated returns address. This request does not shorten any statutory deadline.
8. PRODUCT USE AND CARE
Use products according to their stated purpose and any care or safety instructions supplied.
Decorative straps, ties and garter details are fashion components. Do not assume they are designed for restraint, load-bearing or other safety-critical use.
Stop using a product if it causes irritation, pain or discomfort. This guidance does not limit our responsibility for product safety or your rights regarding defective goods.
9. CUSTOMER SERVICE AND COMPLAINTS
For product questions, order changes, delivery concerns or complaints, email hello@noirelith.com.
Include your order number and a description of the issue where relevant. We may request reasonable supporting information, such as photographs of a damaged item or packaging. You do not need to provide intimate photographs of yourself.
We will consider complaints fairly and provide any remedy required by applicable law. Contacting us does not prevent you from exercising other lawful remedies.
10. SHOPIFY AND THIRD-PARTY SERVICES
Shopify supplies the technology supporting our store. Unless otherwise expressly disclosed at checkout, your purchase contract is with NOIRELITH LLC, not Shopify.
Payment providers and other service providers may apply their own terms to the services they provide. Their involvement does not remove NOIRELITH’s obligations to you as the seller.
Our website may link to independently operated websites. We do not control their content or practices. This does not exclude liability that cannot lawfully be excluded.
11. INTELLECTUAL PROPERTY AND REVIEWS
Website content is owned by NOIRELITH or used with permission from the relevant rights holders. You may use the website for personal shopping and other uses permitted by law. Unauthorised commercial copying or misuse of protected content is prohibited.
If you voluntarily submit a review for publication, you give us a non-exclusive permission to display and reproduce that review for customer information and promotion of our store, subject to applicable law and any consent requirements.
We will not alter a review to misrepresent your experience. Private customer-service correspondence is not automatically licensed for advertising or publication.
Reviews must be honest and must not infringe another person’s rights or contain unlawful content.
12. ACCEPTABLE USE
You must not use the website for fraud, unlawful activity, harassment, infringement of intellectual property rights, distribution of malicious software or interference with the website’s security or operation.
Automated tools must comply with applicable law and must not bypass access controls or disrupt the Services.
We may restrict access where reasonably necessary to address unlawful activity, security threats or a material breach of these Terms. Such action does not remove rights relating to valid existing orders.
13. WEBSITE AVAILABILITY AND LIABILITY
We take reasonable care in operating the website but cannot promise uninterrupted or error-free access.
Products must meet the descriptions, quality and safety standards required by applicable law. Nothing in these Terms excludes mandatory product guarantees, warranty rights or remedies.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the relevant contract was made, or for business losses arising from purchases made for personal use.
Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
14. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of the State of Wyoming, United States, subject to applicable conflict-of-law rules and mandatory consumer protections.
If you reside in another jurisdiction, this choice of law does not deprive you of mandatory protections that apply to you under the law of your habitual residence.
Nothing in these Terms requires you to bring a claim in Wyoming where applicable law gives you the right to bring proceedings in your local courts, or restricts your access to a competent consumer authority or other mandatory dispute-resolution mechanism.
15. CHANGES TO THESE TERMS
We may update these Terms for future use of the website and future purchases. The effective date will be shown above.
The version applicable when your order was placed will continue to govern that order unless a change is required by law or you expressly agree otherwise.
Where applicable law requires notice or consent for a change, we will provide notice or obtain consent.
16. GENERAL
If a provision is unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure to enforce a provision immediately does not waive the right to enforce it later.
If we transfer our business or contractual obligations, we will ensure that the transfer does not reduce your rights under an existing order and will provide notice where required.
Specific information and commitments agreed when you purchase form part of your order. These Terms do not override mandatory law or permit us to disregard those commitments.
